The taxation of the Mandatory PER varies according to two criteria:

the reason for release (main residence, accident, retirement),
the origin of the amounts invested (deductible, non-deductible payments, premiums, CET, or compulsory contributions).

Deductible payments :
- Capital : subject to income tax, exempt from social security contributions.
- Capital gains : taxed at the Single Flat-Rate Withholding Tax (30%) = 12.8% IR + 17.2% social security contributions, or option for the progressive scale.
Non-deductible payments
- Capital : exempt from income tax and social security contributions.
- Capital gains : taxed at the Single Flat-Rate Withholding Tax of 30% (12.8% IR + 17.2% social security contributions), or option for the progressive scale.
Bonuses or CET :
- Capital : exempt from income tax and social security contributions.
- Capital gains : tax-exempt, but subject to social security contributions of 17.2% .

👉 This case benefits from very favorable taxation and concerns all types of payments (including compulsory contributions).

Capital gains : tax-exempt, but subject to social security contributions of 17.2% .

At retirement age, the Mandatory PER can be liquidated as capital or as a life annuity .

- Capital gains : taxed at the Single Flat-Rate Withholding Tax (30%) = 12.8% IR + 17.2% social security contributions, or option for the progressive scale.
⚠️ Amounts from compulsory contributions cannot be released in the form of capital except in the case where the total annual pension is less than €1,200.)

Deductible payments and compulsory contributions : Free Life Annuity scheme.
- The annuity is taxed as a retirement pension, after a 10% reduction (capped at €4,399 in 2025).
- It is also subject to social security contributions.
Non-deductible payments, premiums, CET : Life Annuity for Consideration scheme.
- Only part of the annuity is taxed, depending on the age at the time of the annuity withdrawal:
  - 70% if you are under 50,
  - 50% between 50 and 59 years old,
  - 40% between 60 and 69 years old,
  - 30% after age 69.
- Social security contributions (17.2%) apply to this taxable portion.
